Article 1: General

Please read them carefully before using Our Service.
By using the Site, you agree to be bound by these Terms and Conditions and to use the Site in accordance with these Terms of Service, our Privacy Policy and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from Published Palette Consulting.
Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service.
Article 1a: Age limit
Age restrictions apply: Published Palette Consulting does not permit those under 18 to use the Service. We do our best to restrict access to our sites, products and services to minors. Even if the content of our products and services is not of a shocking nature, we prefer to target a mature audience capable of understanding the implications and responsibilities of the business world.
Any subscriber who does not meet these criteria will immediately be deleted from our database as soon as this is brought to our attention. Likewise, any customer who does not meet these criteria will be reimbursed and a return of the product (s) concerned will be required.
Article 1b: General Terms
Calls will be recorded for legal purposes.
This contract remains in effect until the book is published.
The contract applies to custom quotes as well.
The Designer may use snippets of transcription, audio, and video from calls for marketing unless the Client opts out in writing before work begins.
The Designer retains ownership of all intellectual property rights to the designs and content.
Any amendments to this agreement must be made in writing and acknowledged by both parties. No verbal agreements will be considered binding.
Neither party shall be liable for any delays or failures in performance resulting from acts beyond their reasonable control, including natural disasters, pandemics, and other unforeseen events.
Article 2: Placing Order
By placing an Order for Products through the Service, you warrant that you are legally capable of entering into binding contracts.
Article 3: Price
The prices are indicated in dollars. The price of items can be changed at any time. However, the price applied to an order will be the one stated at the time of the order.
Article 4: Your information
If you wish to place an Order for Products available on the Service, You may be asked to supply certain information relevant to your order including, without limitation, your name, your email, your phone number, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete.
By submitting such information, you grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of your order.
Article 5: Payment
Payment is due immediately on the date of the order, including for pre-order products. Payments may be made upfront or on a selected payment plan. Any remaining balance is due before publication of the project.
Payment can be made through various payment methods we have available, such as PayPal.
Late payments incur a 10% fee of the total plan for each day past due after two days.
Payment of the upfront fee or first payment plan installment signifies agreement to these terms and conditions.
All balances must be paid before the book is published.
Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, we will not be liable for any delay or non-delivery of your order.
Article 6: Project
This section outlines the specific services and products that the Designer will carry out and guidelines that the Client agrees to adhere to
Article 6a: Content Guidelines
No nudity or gore.
No sexually explicit images or quotes.
No graphic depictions of violence.
Content must be respectful and appropriate for all audiences.
All contributions will be reviewed for adherence to these guidelines.
Article 6b: Submission Terms
By submitting your work, you agree that your submission will be used for the commercial purposes of the book.
Text submissions may be edited for length, clarity, and grammar.
Photographs and advice blurbs will receive specific credit.
Quotes will not receive direct credit but will be acknowledged in the contributors list.
Each contributor will be listed unless they request anonymity in writing. This option is not available for Tier 3 contributors.
Article 6c: Compensation and Distribution
Complimentary copies will be sent out for applicable tiers (2, 3, 4, 5, 6) where possible. If not possible, the retail publish price will be refunded.
Wholesale access is given to Tiers 3 and 4 for two years from the publication date, and lifetime access for Tiers 5 and 6.
Tiers 3 and 4 may distribute any remaining books after the two years, though wholesale access ends after this period.
Suggested retail price: $50-$65 USD.
Wholesale price: $25-$40 USD (excluding shipping and handling costs).
Prices are subject to change based on, but not limited to, factors such as changes in Amazon shipping prices or other shipping costs.
Article 7: Changes to these Terms and Conditions
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Service.
Article 8: Publishing
Once the publish date is set on Amazon, it cannot be changed.
The Designer does not guarantee additional profits, sales, exposure, or brand recognition from deliverables. There is no responsibility for unmet Client expectations.
Delays in Client responses will result in publication delays. For major holidays, add corresponding days to delivery time.
Article 9: Dispute Resolution
Any disputes arising out of or in connection with this agreement shall be resolved through mediation. If mediation fails, the dispute shall be settled in the jurisdiction of New York.
