Article 1: General

Our Terms and Conditions were last updated on 01/20/2025.

Please read them carefully before using Our Service.

By using the Site, you agree to be bound by these Terms and Conditions and to use the Site in accordance with these Terms of Service, our Privacy Policy and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from Published Palette Consulting.

Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service.

Article 1a: Age limit

Age restrictions apply: Published Palette Consulting does not permit those under 18 to use the Service. We do our best to restrict access to our sites, products and services to minors. Even if the content of our products and services is not of a shocking nature, we prefer to target a mature audience capable of understanding the implications and responsibilities of the business world.

Any subscriber who does not meet these criteria will immediately be deleted from our database as soon as this is brought to our attention. Likewise, any customer who does not meet these criteria will be reimbursed and a return of the product (s) concerned will be required.

Article 1b: General Terms

Calls will be recorded for legal purposes.

This contract remains in effect at all times.

The contract applies to custom quotes as well.

The Designer may use snippets of transcription, audio, and video from calls for marketing unless the Client opts out in writing before work begins.

The Client agrees to credit the Designer as the designer on the copyright page and back cover.

The Designer may use sections of the Client's book for marketing purposes.

The Designer retains ownership of all intellectual property rights to the designs and content created until the Client has made full payment. Upon receipt of final payment, the Client is granted a non-exclusive, perpetual license to use the final product.

Any amendments to this agreement must be made in writing and acknowledged by both parties. No verbal agreements will be considered binding.

The Client agrees to indemnify and hold harmless the Designer from any claims, damages, losses, or expenses arising out of or related to the project.

Both parties agree to maintain the confidentiality of all proprietary information disclosed during the project. This includes, but is not limited to, design concepts, business strategies, and personal information.

Neither party shall be liable for any delays or failures in performance resulting from acts beyond their reasonable control, including natural disasters, pandemics, and other unforeseen events.

Article 2: Placing Order

By placing an Order for Products through the Service, you warrant that you are legally capable of entering into binding contracts.

Article 3: Price

The prices are indicated in dollars. The price of items can be changed at any time. However, the price applied to an order will be the one stated at the time of the order.

Article 4: Your information

If you wish to place an Order for Products available on the Service, You may be asked to supply certain information relevant to your order including, without limitation, your name, your email, your phone number, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete.

By submitting such information, you grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of your order.

Article 5: Payment

Payment is due immediately on the date of the order, including for pre-order products. Payments may be made upfront or on a selected payment plan. Any remaining balance is due before publication of the project.

Payment can be made through various payment methods we have available, such as PayPal or Stripe.

Late payments incur a 10% fee of the total plan for each day past due after two days.

Payment of the upfront fee or first payment plan installment signifies agreement to these terms and conditions.

All balances must be paid before the book is published.

Any extra expenses must be approved and paid for by the Client.

Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, we will not be liable for any delay or non-delivery of your order.

All deposits made towards any of our services are strictly non-refundable. This policy ensures the allocation of time, resources, and planning dedicated to your project from the moment your deposit is received.

Any payments made as part of a payment plan are also non-refundable. These payments represent a commitment to the project and cover ongoing work, materials, and resources allocated throughout the process. By agreeing to a payment plan, you acknowledge and accept this non-refundable policy.

We recommend that you review your decision carefully before making any payments. If you have any questions or require clarification, please reach out to our team before proceeding with your payment.

Article 6: Project

This section outlines the specific services and products that the Designer will provide to the Client. It details the various aspects of book creation, from initial concept designs to final publication preparations. Each deliverable is designed to ensure that the Client receives a comprehensive and professionally crafted book ready for publication.

Article 6a: Project Termination

If either party terminates and bills are unsettled, the Client cannot use or recreate the work done.

After publishing, the Client owns all rights and royalties.

Limitation of liability: Neither party is liable for any damages, including loss of revenue, anticipated profit, or business, arising from this agreement.

If the Client wants their own ISBN instead of using Amazon’s free one, they must provide it.

No refunds are offered once design work starts. If the Client backs out while on a payment plan, the full amount is still due.

Backing out after making a deposit or initial payment incurs a 25% fee of the total price, not including the payment already made.

Editable files will be released after the book is published and all balances are paid.

This Agreement represents the entire agreement between the Parties. Any modifications must be in writing and signed by both parties.

Article 7: Changes to these Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Service.

Article 8: Approving Design and Writing

Once a section is shown and approved by the Client, the Designer will create the design based on it. Only 3 small changes can be made afterward. Redesign and rewriting will incur extra charges, subject to the Designer's discretion.

Pages are defined as one side of a sheet of paper. Blank pages count toward the total page count of the tier. Any non-blank page outside of the page count for the tier will be charged at $50 per page. Some blank pages may be necessary to make page turns work.

The Client must approve the design before submission to Amazon. The Designer is not liable after the Client approves the design.

Scope determination is at the Designer's discretion, with the option to decline requests or bill extra for out-of-scope work.

Article 9: Amazon

The Client must set up an Amazon KDP account under their name and share credentials for uploading.

Credentials will be kept confidential.

If opting out of sharing credentials, a 1-hour call will be provided for screen sharing and guidance. Additional time is billed at $75 per hour.

7 calendar days will be added to project deliverables if a proof copy is requested before publishing. Additional days may be required for changes after proof receipt and additional proofs.

The Client is responsible for purchasing proof copies.

The Designer does not represent Amazon or work for Amazon.

The Designer is not liable for any changes that Amazon chooses to make.

If Amazon terminates the Client's account, the Client is still responsible for paying the Designer the full amount.

Article 10: Publishing

Once the publish date is set on Amazon, it cannot be changed. Changes post-publication may be billed as out-of-scope work.

The Designer does not guarantee additional profits, sales, exposure, or brand recognition from deliverables. There is no responsibility for unmet Client expectations.

Delays in Client responses will result in publication delays.

For major holidays, add corresponding days to delivery time.

Article 11: Tiers

This section describes the different service packages available, specifying the number of pages, timelines, and response requirements for each tier.

  • Start Date: The day of the scheduled onboarding call.

  • Editing and Formatting Artwork: Small alterations to make the piece compatible with the book and presentable.

  • Front and Back Cover Design: A design made using the Designer’s own art or elements available to the Designer. The Designer shall not supply or commission original artwork. If the Client requires original artwork, they must provide it.

  • Top Hitting Keyword Research: Keywords with high search volume and low competition on the date of the research.

  • Customized Marketing Strategy: A comprehensive plan outlining the actions the Client should take to achieve their marketing goal, as provided by the Client. The Designer will create the entire plan, but execution of the plan is the Client’s responsibility unless they choose to hire the Designer for additional marketing services.

  • Priority Feedback & Edits: Responses from the Designer within one business day.

  • VIP Support: Access to same-day replies via text or email.

  • Launch Event Coordination: Assistance with finding a venue, creating a guest list, developing marketing materials for the event, and creating a complete event plan. The Client is responsible for all financial costs associated with the event.

  • Ghostwriting and Editing Manuscript Based on Your Vision

  • Internal Content Creation

  • Professional Formatting

  • Front and Back Cover Design

  • Upload to Amazon KDP

  • Top Hitting Keyword Research

  • Optimized Amazon Description

  • ISBN and Barcode Guidance

  • Market Price Analysis

  • Client responses within 24 hours via email or text are required.

Article 11b: Tier 2—Elevate

  • Up to 100 Pages

  • Book Concept Creation

  • Editing and Formatting Artwork

  • Ghostwriting and Editing Manuscript Based on Your Vision

  • Internal Content Creation

  • Professional Formatting

  • Front and Back Cover Design

  • Upload to Amazon KDP

  • Top Hitting Keyword Research

  • Optimized Amazon Description

  • ISBN and Barcode Guidance

  • Market Price Analysis

  • Customized Marketing Strategy

  • 12 Social Media Marketing Posts

  • Custom Author Website includes Home, About, Contact, Blog, and Shop Pages; client is responsible for the content in the blog and shop pages; client is responsible for domain purchase

  • Priority Feedback & Edits

  • Client responses within 48 hours via email or text are required.

Article 11c: Tier 3—Illuminate

  • Up to 100 Pages

  • Book Concept Creation

  • Editing and Formatting Artwork

  • Ghostwriting and Editing Manuscript Based on Your Vision

  • Internal Content Creation

  • Professional Formatting

  • Front and Back Cover Design

  • Upload to Amazon KDP

  • Top Hitting Keyword Research

  • Optimized Amazon Description

  • ISBN and Barcode Guidance

  • Market Price Analysis

  • Customized Marketing Strategy

  • 12 Social Media Marketing Posts

  • Custom Author Website includes Home, About, Contact, Blog, and Shop Pages; client is responsible for the content in the blog and shop pages; client is responsible for domain purchase

  • Priority Feedback & Edits

  • In-Person Collaboration includes 5 days of work 2 hours per day. Days must be consecutive not including weekends and must be completed within 8 consecutive calendar days unless otherwise agreed upon

  • Book trailer

  • VIP Support

  • Professional Photoshoot

  • Launch Event Coordination

  • Client responses within 48 hours via email or text are required.

Article 11d: Custom Projects

  • As outlined in communication with client.

Article 12: Dispute Resolution

Any disputes arising out of or in connection with this agreement shall be resolved through mediation. If mediation fails, the dispute shall be settled in the jurisdiction of New York.
